The U.S. Court of Appeals for the Ninth Circuit denied the Trump administration’s request to pause a lower court order on Friday, clearing the path for Temporary Protected Status protections for Venezuelans to potentially resume on November 6.

The legal battle began when the administration moved to cancel TPS for Venezuelans, prompting a district court to intervene. The government appealed that decision to the Ninth Circuit. The case reached the Supreme Court on a procedural emergency, where the high court allowed the lower court order to stand temporarily while the appeals process continued.

The National TPS Alliance stated that this ruling opens the door for protections to be reinstated once the current suspension expires. José Guerrero, an immigration lawyer, clarified that the core dispute remains unresolved. The courts have focused on the suspension of the district court order rather than the final merits of the case.

Guerrero explained that if the government does not file an appeal or if the Supreme Court rejects a new emergency petition to maintain the pause, the TPS status would technically be restored. He noted that the government has not yet announced a formal termination of the program. Under current law, if the government fails to announce an end date 60 days in advance, protections can be reinstated automatically.

Ambiguity remains regarding the effective date of any restoration. Guerrero pointed out that it is unclear whether the reinstatement period would begin from October 2 or November 6. The administration has not confirmed its next legal moves. The government must decide whether to appeal the Ninth Circuit’s decision or let the suspension lapse.

As of now, the TPS has not been officially reinstated. The November 6 date serves as the critical threshold. If the government does not act to maintain the pause before that date, the protections for Venezuelan nationals are expected to return. Legal experts advise that the situation remains fluid until the government’s next filing or the appellate court’s final directive.
