Ex-FBI Intelligence Leads Charged Over Hunter Biden Laptop Testimony
Prosecutors allege two former officials lied to Congress about their roles in the 2019 laptop inquiry.

The Department of Justice charged two former FBI executives with making false statements to Congress regarding the bureau’s handling of investigations into Hunter Biden. The indictment was announced on Friday against Nikki Floris, a former intelligence division leader, and Bradley Benavides, a former deputy assistant director for counterintelligence.
Prosecutors allege that both officials intentionally concealed key details while testifying before the House Judiciary Committee in 2023. Floris denied any involvement in the probes, yet an FBI affidavit states she was in frequent communication with the case team for over a year. She also claimed she knew nothing about the laptop, according to the filing, despite coordinating the FBI’s response to media reports in real time.
Benavides testified several months after Floris. He told the committee he knew little about the matter, claiming he learned about the laptop from a Wikipedia entry while preparing his answers. The affidavit counters this by stating he was in constant communication about the device over a period of days. A committee member noted that these answers influenced the investigation by blocking follow-up interviews and subpoenas.
If convicted, each defendant faces a maximum prison sentence of five years. Both were released on Friday morning after a brief appearance before a federal magistrate judge. US Attorney Jeanine Pirro, who is leading the prosecution, said the pair undermined the institutions they served. She stated that lying to Congress strikes at the heart of the democratic system and that when senior agents believe they are above the law, it is time to bring the hammer of justice down on them.
Defense lawyers rejected the allegations. Floris’s attorneys argued the government accused her falsely based on the say-so of politicians rather than facts. They described her as a patriot who served as an FBI intelligence officer for nearly 20 years. They added that it was no coincidence the charges were filed years later, on the eve of an election. Ron Safer, representing Benavides, asked the court to hold a hearing on whether prosecutors had enough evidence against two lifetime public servants.
US Magistrate Judge Zia M. Faruqui raised concerns about the timing of the case. He noted the charges were filed more than three years after the testimony. Faruqui granted the defense request for a hearing to weigh the government’s evidence, setting the date for Tuesday. He called the timeline rare but acknowledged the defendants had sparkling backgrounds in law enforcement and an interest in clearing their names quickly. He described the situation as a Sword of Damocles hanging over their heads.
The laptop at the center of the case was handed to the FBI in 2019. A computer shop owner told authorities that Hunter Biden had dropped it off and never returned to collect it. The owner said he turned the device over to the FBI after viewing some of its contents. The case arrives as many FBI agents who worked on investigations involving President Donald Trump have been pushed out of the bureau since the start of his second term.
